It is possible for a divorce to be handled simply and cheaply. Below are answers to some of the most frequent questions we get asked as family lawyers.

What’s the cheapest way to get a divorce?

Simple, uncontested divorce. If you and your spouse are able to discuss and come to a mutual agreement on all issues, including the division of assets, spousal/child support (where applicable), and child related issues, one of you can instruct a divorce lawyer who will then prepare the necessary documentation to sign thus avoiding the need to attend court.

What if we do not agree on all issues?

You may engage the services of a divorce lawyer who is trained in “Mediation”.

During this Mediation Session, parties appear before a mediation-trained lawyer who assists the parties in identifying the issues and interests, helps them explore settlement alternatives, and draw up an amicable agreement.

Thereafter, the mediator/lawyer will proceed to prepare the divorce papers and the matter is set down to proceed on a fast-track basis.

How do I make sure that my partner does not renege on the agreed terms?

When parties agree on the terms of the divorce, the agreement is lodged with the Court for approval by a Judge.

Once approved by the Court, it becomes a binding Order of Court. Should your partner breach the Order, you may wish to carry out enforcement proceedings in order to get him/her to comply.
